    How Do I Negotiate A Divorce Settlement With My Spouse?

    The Four Alternatives

    There are four alternative ways of going this:

    1. By agreement with your spouse.
      You then get your solicitor to draft up the agreement and make it into a Court Order.
    2. By attending mediation with your spouse.
      A skilled mediator will try and steer you and your spouse towards a sensible agreement.
    3. By instructing your solicitor to get you a settlement.
      That can be done by negotiation between your solicitor and your spouse’s solicitor (or your spouse himself/herself).
    4. By making an application to the Court.
      Your evidence will be presented and your arguments will be heard by the Judge as will your spouse’s. The Court will then make an Order which is binding upon the two of you. That Order is made after the Court has heard all of the evidence and the submissions of your legal representatives.

    It is still open to either one of you to appeal against that decision nonetheless.
